APPROVAL OF MINUTES:  February 21, 2007

Commissioner Anne Ziebell asked if anyone had corrections. No corrections were noted.

ELECTION OF COMMISSION CHAIR:

 

The commission discussed the need to elect a commission chair.  Commissioner Heeter nominated Commissioner Ziebell.  There were no other nominations. 

 

MOTION: I’ll make the motion to elect Commissioner Anne Ziebell Chair of the Public Safety Commission

REPORT TO COMMISSION:

 

 

FIRE DEPARTMENT: GARY DOTSETH

 

Asst. Fire Chief Gary Dotseth mentioned the grass truck has been approved by council.  It should be in the 1st week of April.   The Fire Department also asked that the city start considering adding a third station.  Council Liaison Forseth mentioned it would be part of the Comp Plan update.  The Fire Department is also continuing to research the purchase of a new engine in 2008.  Training on wildfires/grassfires will be held at Cloquet Overlook Park.  This is part of routine maintenance and the Fire Department will work with the DNR and make it a training event for the Fire Department. 

 

It was also mentioned that Friday April 20th will be the date for the annual Fireman’s Dance at the Champlin Legion. 

POLICE DEPARTMENT: CHIEF RICHARD PIETRZAK

 

Chief Pietrzak mentioned that the previously approved candidates have completed their psychological exams.  Three of the candidates passed and one did not.  The three that passed have begun or are soon to begin their training period.  Chief Pietrzak mentioned that with he had three more applicants to be considered that were previously reviewed by Public Safety. They are Chris McGill. David Eidsmo and Andy Lamers. All are currently working as law enforcement officers.  Chris McGill had been a part-time officer in Dayton in the past. David Eidsmo is a retired Hennepin County Sheriff’s Deputy.  Andy Lamers works for the New Hope Police Department.  He will ask council permission, at the next council meeting, to have these three candidates take their psychological exams and add them to the roster.  Chief Pietrzak mentioned he would like to have at least five part-time officers, possibly six on the roster. 

 

 

MOTION:      I make a motion to recommend the City Council consider these three candidates for part-time Police Officer positions, contingent on passing psychological exams.

Chief Pietrzak mentioned working with Clarice Troedson, manager of the trailer park, and some of the residents about stetting up a meeting to discuss the process for becoming a legal citizen. 

 

LIAISON: COUNCIL MEMBER PHIL FORSETH

 

Council Member Forseth mentioned the City is getting ready for the assessment hearing.  There was discussion about what kind of options there were for low income homeowners.  Council Member Forseth mentioned that the bid for the project came in significantly lower than expected.  This would mean a savings of about $3,000 per household. 

 

OLD BUSINESS:

 

There was discussion about the adopting of administrative tags.  Commissioners received the information in their packets regarding ordinances, adopting state codes, and sample fee schedules.  The commission recommended the fees be set at 10% less than the Hennepin County Fees.  They also recommended adding a “three strikes you’re out” provision.  Anyone receiving more than three administrative tags would no longer have that option for any subsequent stops the remainder of the year.  The commission also recommended changing the thirty day time frame allowed for payment to 14 days. 

MOTION:  Motion to recommend to the City Council that they move forward with the administrative tags, set fees at 10% below Hennepin County Fees, change time allowed for payment to 14 days, and add language that states after three administrative tags, violators will only be issued Hennepin County Citations.

There was discussion regarding the need for a rental property ordinance. Having this ordinance, would allow for easier regulation of rental properties.  Problem renters can more easily be removed and if the property is the source of continuous problems, the City can seize the home.  This ordinance would be a deterrent to problem property owners and would encourage the owners to be closely scrutinizing prospective renters. The commission agreed that the sample from Champlin was probably the closest match to what the City of Dayton would need.  They also felt the Belle plain ordinance was worded well.  There was discussion about what requirements should be in place regarding smoke detectors and CO2 detectors (i.e.; how many, where they should be placed) and also about whether fire extinguishers should be required and where they should be located.  This should be clearly addressed in the ordinance. 

The commission also discussed the need to have a section relating to absentee landlords.  If a landlord lives outside the metro area, they have to designate a local contact; someone who would be able to respond to immediate needs.  The Anoka ordinance addressed this issue on page 2 of 4. 

The commission also discussed how long a license should be good for.  They felt it should be renewed at least every other year.  The City Council will also need to decide who would perform the required inspections.  One possibility would be to open this job up to the public.  License a citizen to perform the checks on behalf of the city. 

The commission recommended the section from the Public Peace and Safety regarding trespassing be added to the rental ordinance.  The commission felt the section from the Minneapolis ordinance referring to minimum standards was something that should be included also. 

 

The commission decided to table this item and discuss it further at the next meeting.
